1. Agreement to Terms
Welcome to Cyberlink Ltd ("Cyberlink," "we," "our," or "us"). These Terms of Service govern your access to and use of our platform, website (cyblinkltd.com), APIs, mobile applications, and identity verification services (including NIN, BVN, and CAC verification). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to all of these terms, you must not use our services.
2. Eligibility & Account Registration
To use our services, you must register for a Cyberlink merchant or developer dashboard account. By registering, you warrant that:
- You are at least 18 years of age and possess the legal authority to form a binding contract.
- All registration information you submit is accurate, current, and complete.
- You will maintain the strict security of your login credentials and API keys. You are fully responsible for all actions taken under your account.
3. Use of Identity Verification Services
Cyberlink provides infrastructure and automated pathways for looking up and validating national identities and corporate data:
- Lawful Purpose Only: You agree to utilize our verification endpoints strictly for lawful, authorized business operations, fraud prevention, regulatory compliance, or client onboarding.
- Consent Requirement: You warrant that you have obtained explicit, verifiable consent from individuals or corporate entities before submitting their identification details (such as NIN or BVN) for validation through our system.
- Prohibition of Misuse: You shall not scrape, reverse engineer, resell, or distribute our API data feeds, nor use them to stalk, harass, or perform unauthorized background checks on private individuals.
4. Financial Terms, Wallet Funding, and Refunds
Access to our verification loop is based on a prepaid wallet or subscription pricing tier model:
- Wallet Top-Ups: Funds deposited into your Cyberlink dashboard wallet are non-refundable except where required by law or proven system errors attributable solely to Cyberlink.
- Pricing Adjustments: We reserve the right to alter query pricing tiers, subscription fees, or service limits with prior notice provided via email or dashboard notifications.
5. Limitation of Liability & Service Availability
Our platform relies on external institutional repositories and telecommunication infrastructure. While we strive for 99.9% uptime and instantaneous accuracy:
- Cyberlink provides services on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We shall not be held liable for temporary downtimes, upstream government database outages, network latencies, or indirect, incidental, or consequential damages arising from the use or inability to use our services.
6. Termination of Access
We reserve the right to suspend or terminate your account or API access immediately, without prior notice, if we detect fraudulent activity, breach of data privacy compliance rules, non-payment, or any violation of these Terms of Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Nigeria.
